Allahabad High Court

RISHABH KUMAR AND 2 OTHERSversusSTATE OF UP AND ANOTHER

Decided

Holding

The application for quashing the proceedings under Section 528 B.N.S. is declined.

Summary

The applicants filed an application under Section 528 of the B.N.S. seeking to quash the criminal proceedings arising from a charge sheet dated 31-10-2025 and an order taking cognizance dated 07-01-2026 under Section 69 of the B.N.S. and Section 4 of the D.P. Act. The High Court examined the material and observed that, at the interlocutory stage, it could not be said that no offence was made out against the applicants, as the disputes were factual in nature. The Court held that quash jurisdiction under Section 528 is available only where there is a clear failure of justice or abuse of process, which was not demonstrated. Consequently, the prayer for quashing was declined. The Court directed that, if the applicants are not on bail, they may apply for bail within 45 days, and any application for discharge must also be filed within 45 days and decided by the trial court within two weeks, with no coercive measures to be taken during that period.

Issues considered

  • Whether the High Court can quash the criminal proceedings under Section 528 of the B.N.S. at the interlocutory stage.
  • Whether there is a failure of justice or abuse of process justifying the exercise of quash jurisdiction.
