Allahabad High Court

RIYAZ MOHAMMAD AND 2 OTHERSversusSTATE OF UP AND ANOTHER

Decided

Holding

The High Court declined to quash the criminal proceedings, finding no clear abuse of process or failure of justice at this stage.

Summary

The applicants filed an application under Section 528 of the B.N.S. seeking to quash the criminal proceedings (Criminal Case No. 131 of 2026) initiated against them. The High Court examined the material and observed that the existence of an offence against the applicants could not be dismissed at this interlocutory stage, as the matters raised were factual disputes. The Court held that its power to quash is limited to cases of clear abuse of process or failure of justice, which were not demonstrated. Consequently, the prayer to quash the proceedings was declined. The Court directed that if the applicants are not on bail, they may apply for bail within 45 days, and any discharge application must be decided by the trial court within six weeks, with no coercive measures taken during that period.

Issues considered

  • Whether the High Court can quash criminal proceedings under Section 528 of the B.N.S. on the ground of alleged abuse of process or failure of justice.
  • Whether the Court can direct the trial court to entertain bail or discharge applications within specified time frames.
