Allahabad High Court

UMESH YADAVversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The order is valid and the application under Section 528 is dismissed.

Summary

The applicant filed an application under Section 528 of the Indian Penal Code challenging an interlocutory order dated 18‑02‑2026 passed by the Additional Principal Judge of the Family Court, Deoria, under Section 145 of the B.N.S.S. code. The applicant’s counsel argued that the order was not based on a proper factual assessment and was merely speculative, thus warranting its setting aside. The respondent’s counsel contended that the order was issued after adequate consideration and contained no legal or jurisdictional error. After hearing both sides and reviewing the records, the High Court held that the order was founded on a proper and reasoned evaluation of facts and was free of any procedural or jurisdictional defect. Consequently, the application under Section 528 was dismissed and the order left undisturbed.

Issues considered

  • Whether the interlocutory order passed by the Family Court is vitiated by lack of proper factual consideration and thus liable to be set aside under Section 528 of the Indian Penal Code
  • Whether the order suffers from any legal or jurisdictional error warranting its annulment
