Allahabad High Court

MUNSHI RAM AND 6 OTHERSversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The court declined to quash the proceedings and ordered that bail applications filed within 45 days be entertained, with a stay on coercive measures during that period.

Summary

The applicants filed an application under Section 528 of the Criminal Procedure Code seeking to quash the criminal proceedings against them and to be allowed to appear through counsel before the Additional Chief Judicial Magistrate in Moradabad. The court examined the material and found that the allegations against the applicants were not yet determined and involved factual disputes that could not be decided at this stage. Consequently, the court declined the prayer for quashing, noting that such power is exercised only in cases of clear abuse of process or failure of justice. The court directed that if the applicants are not on bail, they may appear through counsel and file a bail application within 45 days, which will be considered expeditiously. It also ordered that any application for discharge be decided by the trial court within six weeks and that no coercive measures be taken against the applicants for 45 days or until the discharge application is disposed.

Issues considered

  • Whether the application under Section 528 CrPC for quashing of the criminal proceedings should be allowed.
  • Whether the court can direct the applicants to appear through counsel and stay coercive measures pending bail or discharge applications.
