Allahabad High Court

TANUJversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The application under Section 528 CrPC is dismissed as no sufficient ground for quashing the chargesheet or proceedings exists.

Summary

The applicant, Tanuj, filed an application under Section 528 of the Criminal Procedure Code seeking to quash the chargesheet dated 29‑09‑2024, the cognizance and summoning order dated 11‑02‑2025, and the entire proceedings of Case No. 90 of 2025 (State vs. Tanuj) arising from an FIR under Section 354 IPC. The High Court examined the FIR, the impugned order, the chargesheet and the victim’s statement and found no sufficient ground to interfere with the criminal proceedings. Consequently, the Court refused the prayer to quash the chargesheet and dismissed the application. The Court, however, directed that if the applicant surrenders within 15 days and applies for bail, the bail application should be decided expeditiously, citing the precedent of Satender Kumar Antil v. CBI. Until the 15‑day period expires, no coercive action shall be taken against the applicant.
