Allahabad High Court

ASHISH @ CHHOTA AND 2 OTHERSversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The court held that no ground existed to quash the chargesheet, cognizance order or the proceedings, and therefore dismissed the application.

Summary

The applicants filed an application under Section 528 of the Criminal Procedure Code seeking to quash the chargesheet dated 12‑11‑2025, the cognizance and summoning order dated 01‑01‑2026, and the entire proceedings in Case No. 48 of 2026 arising from FIR charges under IPC sections 110, 118(1), 115(2) and 351(3). The High Court examined the FIR, the chargesheet and the injury report and found no material to justify interference or quashing of the proceedings. Consequently, the court refused the prayer to set aside the chargesheet and orders. It directed that the applicants may surrender within 15 days and apply for bail, and that no coercive action be taken against them during that period. The application was therefore dismissed.
