Allahabad High Court

SALMAN AND 3 OTHERSversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The court rejected the application to quash the summoning order, holding that the allegations disclose a cognizable offence and Section 528 does not require the court to assess their correctness.

Summary

The applicants filed an application under Section 528 of the B.N.S. seeking to quash the summoning order dated 27‑02‑2026 in Complaint Case No. 3308 of 2025, which was filed under Sections 333, 115(2), 352, 351(2) and 74 of the B.N.S. The complaint alleged a cognizable offence and was supported by statements recorded under Sections 200 and 202 of the Criminal Procedure Code. The High Court examined the record and held that the allegations disclosed a cognizable offence, and that under Section 528 the court is not required to assess the correctness of the allegations or the reliability of the evidence. Consequently, the prayer to quash the summoning order and the pending proceedings was rejected. The applicants also requested that the lower court be directed to consider their bail applications; the Court referred to the Supreme Court’s guidelines in Satendra Kumar Antil v. CBI and declined to issue any specific direction, noting that the lower court is expected to follow those guidelines. The application was therefore disposed of.

Issues considered

  • Whether the summoning order in the criminal complaint can be quashed under Section 528 of the B.N.S.
  • Whether the High Court should issue a direction to the lower court to consider bail for the applicants
