Allahabad High Court

MOHAN LAL AND 6 OTHERSversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The application under Section 528 CrPC seeking quashment of the charge sheet and related orders is dismissed.

Summary

The applicants filed an application under Section 528 of the Criminal Procedure Code seeking to quash the charge sheet dated 7‑8‑2025, the cognizance and summoning order dated 20‑2‑2026, and the entire proceedings of State v. Mohan Lal and others (Case No. 864 of 2026). The court examined the FIR, the impugned order and the charge sheet and found no ground for interference or for setting aside the order. Consequently, the application for quashing was dismissed. The court, however, directed that the applicants may surrender within 15 days and apply for bail, with no coercive action to be taken during that period. The bail application, if filed, should be decided expeditiously in line with the Supreme Court’s decision in Satender Kumar Antil v. CBI.
