Allahabad High Court

SANJAY JAISWAL AND 3 OTHERSversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The Court held that no ground exists to interfere with the charge sheet and proceedings, and therefore dismissed the application for quash.

Summary

The petitioners, Sanjay Jaiswal and three others, filed an application under Section 528 of the Criminal Procedure Code seeking to quash the charge sheet dated 1‑3‑2025, the cognizance and summoning order dated 3‑11‑2025, and the entire proceedings of State v. Sanjay Jaiswal (Case No. 1054 of 2025) arising from FIR charges under IPC sections 115(2), 352, 351(2), 333 and 117(2). The High Court examined the FIR and the impugned documents and found no ground for interference under Section 528, thereby refusing the petitioners' prayer to set aside the charge sheet and proceedings. The court, however, directed that the petitioners may surrender within 15 days and apply for bail, with no coercive action to be taken against them during that period, citing the Supreme Court decision in Satender Kumar Antil v. CBI. The application was ultimately dismissed.
