Allahabad High Court

HIMANSHU DUBEY @ OMversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The High Court directed that the original deed of compromise be filed before the lower court for verification before any order to quash the proceeding can be entertained.

Summary

The applicant, Himanshu Dubey, filed an application under Section 528 of the BNSS seeking to quash criminal proceedings arising from a matrimonial dispute involving charges under Sections 498A, 504, 506 IPC and the Dowry Prohibition Act. The applicant claimed that the parties had amicably settled the dispute and produced a written compromise dated 25‑06‑2024. The State opposed, arguing that the compromise had not yet been verified by the trial court. The High Court held that the compromise must first be filed before the lower court for verification and directed the applicant to do so within 15 days. The court further ordered that no coercive action be taken against the applicant until verification, and that a fresh application under Section 528 may be filed after verification.

Issues considered

  • Whether a written compromise between parties can be used to quash pending criminal proceedings under Section 528 BNSS.
  • Whether the compromise must be verified by the trial court before the High Court can entertain the application.
