Allahabad High Court

SHIVAM PALversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The court held that the application under Section 528 CrPC is not maintainable as there are no grounds to quash the charge‑sheet or the proceedings.

Summary

The applicant, Shivam Pal, filed an application under Section 528 of the Criminal Procedure Code seeking to quash the charge‑sheet dated 29‑05‑2025, the cognizance and summoning order dated 01‑01‑2026, and the entire criminal proceedings in Case No. 1957 of 2026. The High Court examined the record and found no sufficient ground to interfere with the charge‑sheet or the proceedings. Consequently, the court refused the prayer to quash the documents and the case. However, the court directed that the applicant may surrender within 15 days and apply for bail, with the bail application to be decided expeditiously, citing Satender Kumar Antil v. CBI. The court also ordered that no coercive action be taken against the applicant during the 15‑day period.

Issues considered

  • Whether the applicant has sufficient grounds under Section 528 CrPC to quash the charge‑sheet, cognizance order and the criminal proceedings.
  • Whether the court can grant liberty to the applicant to surrender and seek bail pending the disposal of the application.
