The court refused to quash the summoning order but directed surrender within three weeks, stayed the non‑bailable warrant, and ordered expeditious disposal of the bail application.
Summary
The applicant, Smt. Sabra Begam, filed an application under Section 528 of the Bail and Non-bailable Summons (BNSS) seeking to quash a summoning order dated 18.01.2018 issued by the Civil Judge/Judicial Magistrate in a criminal complaint involving sections 498‑A, 323, 504, 506 IPC and sections 3/4 of the Dowry Prohibition Act. During the hearing, the applicant’s counsel withdrew the challenge to the criminal proceedings and instead requested protection to enable the applicant to surrender before the lower court and to have any bail application decided expeditiously. The State’s Additional Government Advocate expressed no objection to granting short‑term protection for surrender. The High Court refused to quash the summoning order but directed the applicant to surrender within three weeks, stayed the non‑bailable warrant dated 29.09.2018, and ordered that any bail application be disposed of swiftly in line with the Supreme Court guidelines in Satender Kumar Antil v. CBI. The application under Section 528 BNSS was consequently disposed of.
Issues considered
- Whether the summoning order under Section 528 BNSS can be quashed.
