Allahabad High Court

SUSHIL CHAUDHARY @ SURENDRA SINGHversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The High Court quashed the criminal proceeding under Section 528 CrPC, holding that the compromise between the parties justified dismissal despite the offences being non‑compoundable.

Summary

The applicant, Sushil Chaudhary, filed an application under Section 528 of the Criminal Procedure Code seeking to quash a criminal proceeding (Criminal Case No.3600323 of 2006) pending before the Small Cause Judge/Additional Chief Judicial Magistrate, Moradabad, arising from offences under Sections 386 and 506 IPC. The parties had reached an amicable compromise, which was verified by the Small Cause Judge on 02.09.2026. Both parties consented that continuing the prosecution would serve no purpose and would be contrary to the interests of justice. Relying on Supreme Court precedents (Gian Singh v. State of Punjab and Madhavrao Jiwajirao Scindia v. Sambhajirao Angre) that allow quashing of non‑compoundable offences where a genuine settlement exists, the High Court held that the proceeding should be dismissed. Consequently, the application was allowed and the criminal proceeding was quashed.

Issues considered

  • Whether a criminal proceeding for non‑compoundable offences (IPC 386, 506) can be quashed under Section 528 CrPC on the basis of a compromise between the parties.
  • Whether the High Court has jurisdiction to quash such proceedings in the interest of justice.

                                                                   2

                                    5. A three-Judge Bench of the Supreme Court in Gian Singh v. State of
Punjab & another, (2012) 10 SCC 303, has observed in para 58 of the
said judgment that where the High Court quashes a criminal proceeding
having regard to the fact that the dispute between the offender and the
victim has been settled although the offences are not compoundable, it
does so as in its opinion, continuation of criminal proceedings will be an
exercise in futility and justice in the case demands that the dispute
between the parties is put to an end and peace is resorted; securing the
ends of justice being the ultimate guiding factor.

                                    6. In the case of Madhavrao Jiwajirao Scindia v. Sambhajirao
Chandraojirao Angre, [(1988) 1 SCC 692], Hon'ble the Apex Court has
also observed that where matters are also of civil nature i.e. matrimonial,
family disputes, etc. the Court may consider "special facts", "special
feature" and quash the criminal proceeding to encourage genuine
settlement of disputes between the parties.

                                    7. Keeping in mind the position of law and facts, circumstances of the
case, impugned order dated 27.05.2025 (Annexure-1) and cognizance
