Allahabad High Court

MANTOSH RAMversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The application is dismissed as not pressed because the matter has been resolved by the AGA’s finding of forgery.

Summary

The applicant, Mantosh Ram, filed an application under Section 528 of the Indian Penal Code seeking relief concerning a birth certificate issued on 21‑11‑2023. The State’s Additional Government Advocate was directed to verify the authenticity of the certificate. The AGA’s compliance report concluded that the birth certificate was forged. When confronted with this finding, the applicant’s counsel requested dismissal of the application on the ground that it was no longer pressed. The Court agreed and dismissed the application as not pressed, leaving any interim relief dismissed as well.
