Allahabad High Court
ANCHAL RASTOGIversusSTATE OF U.P. AND 2 OTHERS
- Decided
- Bench
- CHAWAN PRAKASH
Holding
The Court held that the application for quash cannot be entertained in the absence of the certified trial‑court order and directed the trial court to report on the status of the proceedings.
Summary
The applicant Anchal Rastogi filed an application under Section 528 of the BNSS seeking to quash the criminal case No. 1336 of 2018 (State v. Sachin Rastogi et al.) which involved offences under Sections 498‑A, 323, 504 IPC and the Dowry Prohibition Act. The High Court noted that the applicant had not produced a certified copy of the trial‑court order and that the opposite parties had not appeared or filed any bail applications. The Court also referred to an earlier application under Section 482 Cr.P.C. that had been withdrawn, directing the trial court to submit a status report on the bail applications and appearance of the accused. Consequently, the Court declined to entertain the quash application and ordered the trial court to report within 48 hours. The matter was listed as fresh on 22‑10‑2026.
Issues considered
- Whether an application under Section 528 BNSS for quashing criminal proceedings can be entertained without a certified copy of the trial‑court order.
- Whether the High Court can quash the proceedings in view of the earlier Section 482 Cr.P.C. application and its withdrawal.
- Whether the trial court is required to secure the appearance of the accused and consider bail applications as per precedent.
