Allahabad High Court
SANJEEV KUMAR AND ANOTHERversusSTATE OF U.P. AND ANOTHER
- Decided
- Bench
- MADAN PAL SINGH
Holding
The High Court held that the criminal proceedings must be quashed as the parties had reached a verified compromise and no useful purpose would be served by continuing the trial.
Summary
The applicants filed an application under Section 528 of the B.N.S.S. seeking to quash the charge‑sheet and all proceedings in Criminal Case No. 3403/9 of 2024, which involved offences under Sections 147, 148, 323, 504, 506 and 336 of the IPC and Section 7 of the Criminal Law Amendment Act. During the pendency of the case the parties entered into a compromise that was verified by the trial court. The State had no objection to quashing the proceedings. Relying on a series of Supreme Court judgments that permit compromise even for certain cognizable and non‑compoundable offences, the High Court held that continuing the trial would serve no useful purpose and therefore ordered the entire case to be quashed. The application was allowed without any order as to costs.
Issues considered
- Whether a criminal proceeding for offences, including non‑compoundable ones, can be quashed on the basis of a court‑verified compromise under Section 528 of the B.N.S.S.
- Whether the High Court has jurisdiction to quash the charge‑sheet and pending proceedings in the said case.
