Allahabad High Court

ASLAM AND 2 OTHERSversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The court quashed the charge‑sheet, cognizance order and all pending proceedings against the applicants on account of a valid settlement reached through mediation.

Summary

The applicants filed an application under Section 528 of the CrPC seeking to quash the charge‑sheet dated 28‑12‑2024, the cognizance/summoning order dated 14‑07‑2025, and the entire criminal proceedings (Case No. 10944 of 2025) relating to offences under Sections 498‑A, 323, 504, 506 IPC and Sections 3 and 4 of the Dowry Prohibition Act. The matter was referred to the Court’s Mediation and Conciliation Centre, where the parties reached an amicable settlement and agreed to withdraw all pending cases against each other. The respondent’s counsel did not contest the settlement. Relying on Supreme Court precedents that allow quashing of criminal proceedings when parties have settled their dispute, the High Court ordered the charge‑sheet, cognizance order and all pending proceedings to be quashed for the applicants. The settlement report was attached to the order and the application was disposed of.

Issues considered

  • Whether criminal proceedings under the IPC and Dowry Prohibition Act can be quashed on the basis of a settlement reached through mediation.
  • Whether the settlement, being voluntary and uncontroversial, suffices to set aside the charge‑sheet and cognizance order under Section 528 CrPC.
