Holding
The High Court refused to quash the proceedings, finding no prima facie case or abuse of process warranting interference.
Summary
The applicant filed an application under Section 528 of the BNSS seeking to quash the proceedings of Case No. 31977 of 2025, which arose from a criminal case against Mahesh Chandra and others. The applicant alleged that the magistrate had treated the matter as a complaint, issued a notice under Section 223 BNSS without summoning the applicant, and that the applicant was released on bail. The High Court examined the record and held that at the preliminary stage there was no indication of a prima facie offence against the applicant and that the disputed factual issues could not be decided at this stage. Consequently, the Court found no ground to invoke its power to prevent abuse of process and refused the prayer to quash the proceedings. However, the Court directed that if the applicant files a bail application within four weeks, it will be considered expeditiously, and no coercive measures will be taken for 30 days.
Issues considered
- Whether the High Court should quash the proceedings of Case No. 31977 of 2025 under Section 528 BNSS.
- Whether there is a prima facie case against the applicant justifying interference.
- Whether the magistrate’s issuance of notice under Section 223 BNSS without summoning the applicant amounts to abuse of process.
