Allahabad High Court

UMAKANT BAJPAI ALIAS PAPPUversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The High Court held that there was no sufficient ground to interfere with the charge sheet or the order, and therefore dismissed the application under Section 528.

Summary

The applicant, Umakant Bajpai alias Pappu, filed an application under Section 528 of the BNSS seeking the quashing of the charge sheet (Report No. 395/2024 dated 25‑12‑2024) and the order dated 12‑06‑2026 in the pending case State vs. Umakant Bajpai (Criminal Writ No. 93995/2025). The High Court examined the FIR, the impugned order and the charge sheet and concluded that the matter did not warrant its intervention and that there was no basis to set aside the order or the charge sheet. Consequently, the application was rejected. However, the court directed that if the applicant surrenders and files a bail application within three weeks, the bail petition should be considered promptly in line with the Supreme Court’s decision in Satender Kumar Antil v. CBI (2022 SCC OnLine SC 825). The court also ordered that no further prosecution action be taken against the applicant for the next three weeks.

Issues considered

  • Whether the High Court can interfere with and set aside the charge sheet and order under Section 528 of the BNSS.
  • Whether the applicant is entitled to bail pending trial.
  • Whether the court can stay further prosecution actions for a specified period.
