Holding
The charge‑sheet under Sections 352 and 351(3) IPC must be treated as a complaint case, and the magistrate’s order treating it as a State case is set aside.
Summary
The applicant, Atul Kumar Pandey, filed an application under Section 528 of the BNSS seeking to set aside a magistrate’s order dated 13 March 2026 that treated a charge‑sheet under IPC Sections 352 and 351(3) as a State case. Pandey argued that these sections relate to non‑cognizable offences and, under Section 2(1)(h) of the Indian Civil Security Code, 2023, the charge‑sheet should be classified as a complaint rather than a police report. He relied on the decisions in Murli v State of U.P., Virendra Singh v State of U.P., and Shakila Bano v State of U.P. to support his view. The opposite counsel could not refute this legal position. The High Court held that the magistrate’s classification was erroneous, quashed the order, and allowed the application in part, while noting that the case may proceed as a complaint if required.
Issues considered
- Whether a charge‑sheet under IPC Sections 352 and 351(3) constitutes a State case (police report) or a complaint case under Section 2(1)(h) of the Indian Civil Security Code, 2023.

HON'BLE SAURABH SRIVASTAVA, J.
Murli and others Vs. State of U.P. and
another, 2008 (61) ACC 54, Virendra Singh and others Vs. State of U.P.
and others, 2002 (45) ACC 609 तथा Shakila Bano and others Vs. State of
U.P. and another, 2008 (61) ACC 636

"2. Definitions.-In this Sanhita, unless the context otherwise requires,-
(h) "complaint" means any allegation made orally or in writing to a
Magistrate, with a view to his taking action under this Sanhita, that
some person, whether known or unknown, has committed an offence,
but does not include a police report.
Explanation. A report made by a police officer in a case which
discloses, after investigation, the commission of a non- cognizable
offence shall be deemed to be a complaint; and the police officer by
whom such report is made shall be deemed to be the complainant."
