Holding

The application under Section 528 BNSS is dismissed as it was not pressed by the applicant.

Summary

Aniket Pandey Carporal filed an application under Section 528 of the Bharatiya Nagarik Suraksha Sanhita seeking to quash the entire criminal proceedings (Session Trial No. 1511 of 2023) arising from charges under IPC sections 376(2)(n), 377, 504 and 506. The application was heard before Justice Sanjay Kumar Pachori, with counsel for the applicant and the State present. The learned Additional Government Advocate noted that prosecution witnesses, including the victim, had already given statements and the trial was at an advanced stage. After hearing arguments, the applicant’s counsel indicated that they did not wish to pursue the application. Consequently, the court dismissed the application on the ground that it was not pressed.
