Holding
The court suspended the NBW for fifteen days on the condition that the applicants appear before the concerned court and file a bail application, which will then be considered as per law.
Summary
The applicants, Mohammad Ali and two others, filed an application under Section 528 of the Indian Citizens Security Code seeking relief from a non‑bailable warrant (NBW) issued under Section 138(B) of the Indian Electricity (Amendment) Act, 2019 in case No. 520/2019. The NBW was issued because the applicants failed to appear on the scheduled date before the Special Judge (EC Act) in Prayagraj. The applicants, through counsel, expressed willingness to appear before the concerned court on a fixed date and to file a bail application. The court examined the submissions and, noting the applicants' readiness to surrender, ordered a conditional suspension of the NBW for fifteen days. It further directed that if the applicants appear within the stipulated period and submit a bail application, their bail plea will be considered in accordance with the law.
Issues considered
- Whether the non‑bailable warrant issued under Section 138(B) of the Indian Electricity (Amendment) Act, 2019 can be suspended pending the applicants' appearance.
- Whether the applicants are entitled to file a bail application after appearing before the court within the stipulated period.
