Allahabad High Court

SHAITAN SINGH YADAV AND 3 OTHERSversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The court held that a prima facie case exists and therefore the application under Section 528 CrPC for discharge of the accused cannot be entertained, leading to its dismissal.

Summary

The petitioners, Shaitan Singh Yadav and three others, filed an application under Section 528 of the Criminal Procedure Code seeking quash of the criminal proceedings initiated against them under the Arms Act and NDPS Act. They argued that no offence was made out and that the prosecution was malicious, highlighting the two‑year delay in filing the FIR. The State opposed, contending that the lower court had validly passed an order and that the petitioners’ contentions were weak. The High Court examined the factual disputes and held that a prima facie case exists, citing precedents that a Section 528 application cannot be entertained where the prosecution appears to have sufficient basis. Consequently, the court rejected the petition to set aside the proceedings. The order was dated 8 September 2026 and directed the copy to be sent to the subordinate court.

Issues considered

  • Whether an application under Section 528 CrPC can be entertained when a prima facie case of offence is evident.
  • Whether the allegations against the petitioners under the Arms Act and NDPS Act constitute a cognizable offence.
  • Whether the delay in registration of the FIR is a sufficient ground to quash the criminal proceedings.
