Holding
The court quashed the entire criminal proceedings as the parties had settled the dispute, finding no useful purpose in continuing the trial.
Summary
The applicants filed an application under Section 528 of the B.N.S.S. seeking to quash the criminal proceedings (Case No. 58225 of 2018) arising from offences under Sections 498A, 323, 506 IPC and Sections 3/4 of the Dowry Prohibition Act. The parties had reached an out‑of‑court settlement on 28‑04‑2026, and the opposite party expressed its willingness to withdraw the prosecution. The High Court examined Supreme Court precedents allowing compromise even in cognizable and non‑compoundable offences. Considering the settlement and the lack of any public interest in continuing the trial, the Court held that the proceedings should be terminated. Accordingly, the entire case was quashed and the application under Section 528 was allowed.
Issues considered
- Whether a compromise between parties can be permitted to quash pending criminal proceedings involving cognizable and non‑compoundable offences under Sections 498A, 323, 506 IPC and the Dowry Prohibition Act.
- Whether Section 528 of the B.N.S.S. empowers the court to dismiss such proceedings on the basis of a settlement.
