Allahabad High Court

NEETI AGNIHOTRIversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The court stayed the execution of the NBW for 15 days on the condition that the applicant appears before the trial court and files a bail application.

Summary

The applicant Neeti Agnihotri filed an application under Section 528 of the Bharatiya Nagrik Suraksha Sanhita seeking to set aside a non‑bailable warrant (NBW) issued in connection with a case (State vs. Akhilesh & others, S. No. 4784/2019). The applicant argued that the NBW was issued because she failed to appear before the trial court, but she is now willing to appear on the scheduled date and file a bail application. The opposing counsel objected to the stay. The court, after hearing both sides, ordered that the NBW be kept in suspension for 15 days provided the applicant appears before the trial court and submits a bail application, after which the trial court will decide the bail matter. The court warned that failure to comply would allow the trial court to proceed with necessary action.

Issues considered

  • Whether a non‑bailable warrant issued under Section 528 can be stayed pending the applicant's appearance before the trial court
  • Whether the applicant is entitled to a conditional stay of execution of the NBW
  • Procedural requirements for obtaining bail in the pending criminal case
