Holding
The court held that where parties have settled and there is no useful purpose in continuing, the proceedings can be quashed even for cognizable, non‑compoundable offences under Section 528 B.N.S.S.
Summary
The applicants filed an application under Section 528 of the B.N.S.S. seeking to quash the charge sheet, cognizance order and the entire criminal proceeding (Criminal Case No.23112 of 2026) arising from offences under Sections 115(2), 85, 351(3) of the B.N.S.S. and Sections 3 and 4 of the Dowry Prohibition Act. The applicants and opposite party No.2 claimed that they had amicably settled the dispute and that the opposite party was willing to withdraw the prosecution. The trial court verified the parties and the compromise application, and the opposite party expressed no objection to quashing the case. The High Court referred to several Supreme Court decisions allowing compromise even in cognizable and non‑compoundable offences. Considering the settlement and the lack of any useful purpose in continuing the prosecution, the Court held that the proceedings could be quashed. Consequently, the charge sheet, cognizance order and the entire criminal case were set aside. The application under Section 528 was allowed.
Issues considered
- Whether a compromise between parties can be permitted to quash proceedings in cognizable, non‑compoundable offences under Section 528 of the B.N.S.S.
- Whether the High Court may set aside a charge sheet and cognizance order on the basis of a verified settlement.
