Allahabad High Court

RANI AND ANOTHERversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The application under Section 528 CrPC is dismissed; the impugned order is not quashed.

Summary

Rani and another filed an application under Section 528 of the Criminal Procedure Code seeking to quash an order dated 23 July 2026 passed by the Additional District and Session Judge in a session case involving offences under Sections 105 and 352 of the IPC. The High Court examined the record and found no sufficient ground to interfere with the impugned order, consequently refusing the prayer for quash. The Court, however, permitted the applicants to surrender before the concerned court within three weeks and to apply for bail, directing that no coercive action be taken against them during that period. The bail application, if filed, must be decided expeditiously as per law. The application was therefore dismissed with the above directions.
