Allahabad High Court

PAWAN GUPTA AND 4 OTHERSversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The court held that the application under Section 528 CrPC is not maintainable and therefore refused to quash the chargesheet and the proceedings.

Summary

The applicants filed an application under Section 528 of the Criminal Procedure Code seeking to quash the chargesheet dated 2 September 2018, the cognizance and summoning order dated 23 March 2019, and the entire proceedings in Case No. 1679 of 2019 (State of U.P. vs. Pawan Gupta & others) arising from FIR under IPC Sections 147 and 341. The High Court examined the FIR, the impugned orders and the chargesheet and found no ground for interference or for setting aside the proceedings. Consequently, the court refused the prayer to quash the chargesheet and the proceedings. The court, however, directed that the applicants may surrender within four weeks and apply for bail, which would be considered expeditiously in line with the Supreme Court decision in Satender Kumar Antil v. CBI. Until surrender, no coercive action shall be taken against the applicants.

Issues considered

  • Whether the application under Section 528 CrPC for quashing the chargesheet and cognizance order is maintainable.
  • Whether there exist sufficient grounds to set aside the chargesheet and the entire proceedings in the criminal case.
  • Whether the applicants are entitled to bail upon surrender after the refusal of the quash application.
