Allahabad High Court

VISHANT @ VISHANT RAGHUVANSHI @ SINGHANIYAversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The High Court held that no ground existed to quash the charge sheet or cognizance order and therefore dismissed the application.

Summary

The applicant filed an application under Section 528 of the Criminal Procedure Code seeking to quash the charge sheet dated 6 March 2026, the cognizance order dated 5 August 2026, and the entire criminal proceedings (Case No. 2689 of 2026) arising from FIR charges under Sections 281, 109(1) and 352 of the Indian Penal Code. The High Court examined the FIR, the impugned order and the charge sheet and found no ground for interference or for setting aside the proceedings. Consequently, the court refused the prayer for quashing. The court, however, allowed the applicant to surrender within three weeks and apply for bail, directing that the bail application be decided expeditiously and that no coercive action be taken during the three‑week period.

Issues considered

  • Whether the High Court can quash the charge sheet and cognizance order under Section 528 CrPC in the present facts
  • Whether any statutory or jurisprudential ground exists to interfere with the criminal proceedings
