Allahabad High Court
ABHISHEK MISHRA ALIAS ABHISHEK VERMA AND ANOTHERversusSTATE OF U.P. AND ANOTHER
- Decided
- Bench
- PADAM NARAIN MISHRA
Holding
The High Court quashed the charge‑sheet, holding that continuation of the criminal proceeding would be futile despite the offences being non‑compoundable.
Summary
The applicants, Abhishek Mishra and another, were charged under IPC sections 363, 366 and 120B following an FIR lodged by Rajesh D. Souja on 1 March 2023. While the criminal case was pending before the Additional Sessions Judge, Kanpur Nagar, the parties, including the victim, entered into an amicable compromise on 26 June 2025. The applicants filed an application under Section 528 BNSS (referred to Section 482 CrPC) seeking quash of the charge‑sheet, arguing that continuation of the trial would be futile. The State opposed, but its own counter‑affidavit acknowledged the compromise. Relying on the Supreme Court’s decision in Gian Singh v. State of Punjab, the High Court held that even non‑compoundable offences may be dismissed where the dispute is settled and justice would be served by ending the proceedings, and consequently quashed the charge‑sheet. The application was allowed and the criminal proceedings were terminated.
Issues considered
- Whether a criminal proceeding for non‑compoundable offences (IPC 363, 366, 120B) can be quashed on the basis of an amicable compromise between the accused and the victim.
- Whether Section 482 of the Criminal Procedure Code empowers the High Court to quash such proceedings.

"58. Where the High Court quashes a criminal proceeding
having regard to the fact that the dispute between the
offender and the victim has been settled although the
offences are not compoundable, it does so as in its opinion,
continuation of criminal proceedings will be an exercise in
futility and justice in the case demands that the dispute
between the parties is put to an end and peace is resorted;
securing the ends of justice being the ultimate guiding
factor."
9. Since, no fruitful purpose would be served by permitting to
continue the criminal case pending before the trial court and it would
simply be a waste of time if the aforesaid case is permitted to
continue till its logical conclusion.
