Allahabad High Court

TUFANI YADAV AND 3 OTHERSversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The court held that there is no ground to interfere with the charge sheet and proceedings, and therefore refused to quash them.

Summary

The applicants, Tufani Yadav and three others, filed an application under Section 528 of the Criminal Procedure Code seeking to quash the charge sheet dated 21‑06‑2024, the cognizance and summoning order dated 31‑07‑2024, and the entire proceedings in case No. 9777 of 2024 relating to offences under Sections 323, 504, 506 and 325 IPC. The High Court examined the FIR, the impugned order and the charge sheet and found no ground for interference under Section 528. Consequently, the court refused the prayer to quash the charge sheet and the proceedings. The court, however, directed that the applicants may surrender within three weeks and apply for bail, which shall be decided expeditiously, and ordered that no coercive action be taken against them during that period. The application was therefore dismissed.
