Allahabad High Court
KUNWAR VIKASH SINGH AND 2 OTHERSversusSTATE OF U.P. AND ANOTHER
- Decided
- Bench
- CHAWAN PRAKASH
Holding
The court held that, given the verified compromise and lack of any useful purpose in continuing the prosecution, the charge sheet and the criminal proceedings are quashed.
Summary
The applicants, Kunwar Vikash Singh and two others, filed an application under Section 528 of the B.N.S.S. seeking to quash the charge sheet dated 19‑04‑2019 and the criminal proceedings in Case No. 419 of 2019, which involved offences under Sections 498A, 323, 504, 506, 377 of the IPC and Sections 3 and 4 of the Dowry Prohibition Act. The applicants claimed that they had amicably settled the dispute with the second opposite party and that the compromise had been verified by the trial court. The State’s AGA raised no objection to the compromise. Relying on Supreme Court precedents that permit compromise even for certain cognizable and non‑compoundable offences, the High Court held that continuing the prosecution would serve no useful purpose and consequently quashed the charge sheet and the entire criminal proceedings. The application under Section 528 was therefore allowed.
Issues considered
- Whether a compromise under Section 528 of the B.N.S.S. can be permitted in cases involving cognizable and non‑compoundable offences such as 498A, 323, 504, 506, 377 IPC and the Dowry Prohibition Act.
- Whether the criminal proceedings and charge sheet can be quashed on the basis of a verified settlement between the parties.
