Allahabad High Court

SAMEER SRIVASTAVAversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The Court held that where the parties have settled their dispute, the criminal proceedings may be quashed under Section 528 of the CrPC.

Summary

The applicant, Sameer Srivastava, filed an application under Section 528 of the CrPC seeking to quash the charge sheet and cognizance order in a criminal case (crime no. 16/2023) involving offences under Sections 323, 504, 506, 498A of the IPC and Sections 3 and 4 of the Dowry Prohibition Act. The applicant asserted that the dispute had been amicably settled and that the settlement was verified by the trial court. The opposite party (respondent No.2) admitted the compromise and raised no objection to quashing the proceedings. The High Court examined the settled nature of the dispute and relied on several Supreme Court precedents that allow quashing of criminal proceedings where parties have reached a settlement. Consequently, the Court exercised its power under Section 528 CrPC and quashed the entire proceedings against the applicant. The application was allowed.
