Holding
The court held that where parties have settled their dispute and the prosecution is withdrawn, the charge sheet and the entire proceeding may be quashed under Section 528 of the B.N.S.S.
Summary
The applicants, Sakib and six others, filed an application under Section 528 of the B.N.S.S. seeking to quash the charge sheet dated 03‑11‑2025 and the entire criminal proceedings (Case No. 09 of 2026) arising from Crime No. 276 of 2025. They asserted that they had amicably settled the dispute with Opposite Party No. 2 and that the latter was willing to withdraw the prosecution. The State’s Additional Government Advocate raised no objection to the compromise. Citing Supreme Court decisions that permit compromise even in certain cognizable and non‑compoundable offences, the High Court held that continuing the prosecution would serve no useful purpose. Consequently, the charge sheet and the entire proceeding were quashed, and the application under Section 528 was allowed.
Issues considered
- Whether a compromise between the parties can justify the quashing of a charge sheet and criminal proceedings under Section 528 of the B.N.S.S. in cases involving cognizable and non‑compoundable offences.
