Allahabad High Court

KRISHNAKANT @ BABA AND ANOTHERversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The court held that the allegations disclose a cognizable offence and, under Section 528 BNSS, the application to set aside the order and grant bail was rejected, leaving the matter to the trial court in accordance with Supreme Court bail guidelines.

Summary

The applicants filed an application under Section 528 of the BNSS seeking to set aside a judgment and order of the Special Judge under the PoxO Act dated 16‑07‑2026, and to obtain bail pending arrest. The High Court examined the allegations, finding that they disclose a cognizable offence and that the court need not assess the veracity of the material collected during investigation before deciding on the bail application. Consequently, the prayer to cancel the order and the bail request was rejected. The court noted the Supreme Court’s guidelines in Satendra Kumar Antil v. CBI for bail considerations and held that the trial court should apply those guidelines without any specific direction from the High Court. The application was therefore dismissed.

Issues considered

  • Whether the order of the Special Judge under the PoxO Act can be set aside under Section 528 of the BNSS.
  • Whether bail can be granted to the applicants pending arrest in view of the Supreme Court’s guidelines in Satendra Kumar Antil v. CBI.
  • Whether the High Court must examine the reliability of the material collected during investigation before entertaining the bail application.
