Allahabad High Court

SANDEEP SINGHversusSTATE OF U.P. AND 2 OTHERS

Decided

Holding

The court held that the dispute is compoundable under Section 152 of the Electricity Act and therefore granted a stay of prosecution pending the filing of a compounding petition.

Summary

The applicant, Sandeep Singh, filed an application under Section 528 seeking modification of pleadings and a stay of prosecution in a power theft case initiated under Section 135 of the Indian Electricity Act. The court allowed the requested amendments and considered the applicant's request to compound the dispute under Section 152 of the Electricity Act. Both parties' counsel argued that the matter was compoundable and that a stay would not prejudice the prosecution. The court held that the dispute could indeed be settled through compounding and directed the applicant to file a compounding petition within two weeks, staying any further prosecution for up to two months or until the petition is disposed. The application under Section 528 was finally disposed with the stipulated directions.

Issues considered

  • Whether the dispute arising under Section 135 of the Electricity Act is compoundable under Section 152.
  • Whether the court may stay prosecution pending a compounding petition under Section 528.
  • Whether the court may permit amendment of pleadings in the pending application.
