Allahabad High Court
RAVISHARAN AND ANOTHERversusSTATE OF U.P. AND ANOTHER
- Decided
- Bench
- CHAWAN PRAKASH
Holding
The court stayed any coercive action for two weeks and ordered that any application for cancellation of the non‑bailable warrant be decided expeditiously.
Summary
The applicants filed an application under Section 528 of the Criminal Procedure Code seeking relief from a non‑bailable warrant issued in a case involving offences under IPC sections 498A, 323, 504, 506 and the Dowry Prohibition Act. The counsel for the applicants indicated that they did not wish to contest the merits and were prepared to appear before the trial court within two weeks to file a fresh application for cancellation of the warrant. The State had no objection to the limited prayer. The High Court, noting the applicants' readiness to approach the trial court, disposed of the application, directing that no coercive action be taken against the applicants for two weeks or until they appear before the trial court, whichever is earlier, and that any application for cancellation of the non‑bailable warrant be decided expeditiously as per law.
Issues considered
- Whether the High Court can stay coercive action against the applicants pending their appearance before the trial court.
- Whether the application for cancellation of a non‑bailable warrant can be entertained without adjudicating the merits of the underlying criminal case.
