Allahabad High Court

SRI OMPRAKASH SHARMAversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The petition under Section 528 BNSS is misconceived and is dismissed.

Summary

The applicant, Sri Omprakash Sharma, filed an application under Section 528 of the BNSS seeking the High Court’s interpretation of a Judicial Magistrate’s letter dated 23 May 2024 and direction to the trial court to comply with an anticipatory bail order dated 29 April 2024. The letter highlighted conflicting orders concerning two accused, Ramkumar Sharma (anticipatory bail under Section 438 Cr.P.C) and Shashi Sharma (stay of proceedings under Section 482 Cr.P.C), and requested guidance. The Court held that the application was misconceived because a Section 528 petition cannot be used to interpret a magistrate’s letter. Consequently, the Court dismissed the application without addressing the substantive issues raised. The dismissal was recorded on 25 March 2026.

Issues considered

  • Whether a petition under Section 528 BNSS can be used to seek interpretation of a Judicial Magistrate’s letter.
  • Whether the High Court can direct the trial court to comply with an anticipatory bail order through a Section 528 application.
