Holding
The High Court held that the criminal proceedings are to be quashed as the compromise is permissible even for the cognizable, non‑compoundable offences involved.
Summary
The applicants filed an application under Section 528 of the B.N.S.S. seeking to quash Criminal Case No. 10472 of 2026, which arose from a complaint under sections 498A, 323 IPC and sections 3/4 of the D.P. Act. The applicants claimed that they had reached a full and amicable compromise with the second opposite party, who no longer wished to pursue the prosecution. The State (opposite party No.1) raised no objection to the compromise and agreed to the quashal of the proceedings. The Court referred to several Supreme Court decisions that permit compromise even in cognizable and non‑compoundable offences. Finding that continuation of the trial would serve no useful purpose, the Court allowed the Section 528 application and quashed the criminal proceedings against the applicants.
Issues considered
- Whether a compromise between parties can be permitted to quash pending criminal proceedings under Section 528 of the B.N.S.S. in cases involving cognizable and non‑compoundable offences such as sections 498A and 323 IPC and the D.P. Act.
- Whether the High Court has jurisdiction to order quashal of the criminal case on the basis of a settlement between the parties.
