Allahabad High Court

NAGENDER @ NARENDRA KUMAR AND 12 OTHERSversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The Court disposed the Section 528 application, directing that bail be considered upon surrender and staying any coercive steps until surrender or three weeks, whichever is earlier.

Summary

The Allahabad High Court heard an application under Section 528 of the BNSS filed by Nagender @ Narendra Kumar and 12 others seeking to quash the criminal proceedings (Criminal Case No. 66019 of 2025) arising from offences under various IPC sections. During the hearing the applicants’ counsel withdrew the prayer to quash and instead expressed willingness to surrender within two weeks and requested that their bail application be decided in accordance with the Supreme Court’s decision in Satender Kumar Antil v CBI. The State’s Additional Government Advocate raised no objection to the amended request. The Court ordered that, subject to the applicants surrendering within the stipulated period, their bail application shall be heard and disposed of according to the precedent, and that no coercive measures be taken against them for up to three weeks or until surrender, whichever is earlier. Consequently, the application under Section 528 was disposed without granting the quash order.

Issues considered

  • Whether the application under Section 528 BNSS can be disposed by directing bail instead of quashing the criminal proceedings
  • Whether coercive steps against the accused may be stayed pending surrender and bail consideration
