Allahabad High Court
MOHD ASLAMversusSTATE OF U.P. AND 4 OTHERS
- Decided

Holding
The High Court held that the magistrate’s summoning order was lawful and therefore could not be quashed.
Summary
The applicant, Mohd Aslam, sought to quash a summoning order dated 20‑11‑2025 issued by the Additional Chief Judicial Magistrate, 4th, Bareilly, which had summoned the opposite parties under Sections 324, 325/34 IPC in a complaint arising from an alleged assault. The applicant contended that a prior compromise agreement, supported by two cheques and cash, had been breached and that the magistrate had ignored medical reports indicating grievous injuries, warranting fresh summons under Sections 323, 504, 307 and 427 IPC. The opposite parties argued that the FIR was baseless, the injuries were simple, and the magistrate’s detailed order was lawful. The High Court examined the evidence, including the medical and X‑ray reports, and found no error in the magistrate’s consideration of facts and law. Consequently, the Court dismissed the application, holding that the impugned order was valid and not liable to be set aside.
Issues considered
- Whether the order of the Additional Chief Judicial Magistrate summoning the accused under Sections 324, 325/34 IPC is liable to be quashed under Section 528 B.N.S.S.
- Whether the magistrate erred in not giving due weight to the medical report indicating grievous injuries.
- Whether the prior compromise agreement bars the continuation of criminal proceedings.
- Whether fresh summons should be directed under Sections 323, 504, 307 and 427 IPC.

3. It is submitted by learned counsel for the applicant that a first
information report was registered as Case Crime No. 510 of 2019, under

that the applicant lodged a first information report on the basis of false
and baseless allegations. After the incident, the applicant was medically
examined and doctor has opined that the injuries are of grievous nature. In
the medical examination report and supplementary report, nowhere stated
that the injuries were dangerous in nature. The learned Magistrate has
taken into consideration the statements of applicant and witnesses under
Sections 200 and 202 Cr.P.C. and given a detailed reasoned order in
passing the impugned order. No offence is made out against them. The

which the accused persons started beating him with sticks and rod.
Hamid, Javed and Arsad were having knife in their hands. Javed attacked
him with knife with intention to kill him whereas Kaleem throttled his
neck with intention to kill him. He became unconscious and fell on the
ground. During investigation, the applicant as well as opposite party nos.
2 to 5 filed a compromise and final report was submitted by the
Investigating Officer. Thereafter a protest petition was filed by the
applicant. The statement of the applicant under Section 200 Cr.P.C. and
witnesses under Section 202 Cr.P.C. were recorded. The learned
Magistrate has summoned the opposite party nos. 2 to 5 under Sections
