Allahabad High Court
NARINDER SINGH CHAUHANversusSTATE OF U.P. AND ANOTHER
- Decided
- Bench
- SAMIT GOPAL
Holding
The court held that there was no ground for interference and dismissed the application under Section 528 BNSS.
Summary
The applicant, Narinder Singh Chauhan, filed an application under Section 528 of the BNSS and Section 482 of the Criminal Procedure Code seeking to quash the charge-sheet and summons issued against him in a cyber‑extortion case. The FIR, lodged by Glenda Roleen Fernandes, detailed a scheme involving impersonation of officials and extortion of large sums, leading to investigations that later named the applicant as an accused despite his name not appearing in the FIR. The applicant argued that he had no involvement, no transactions with co‑accused, and had been granted bail, contending that the charge-sheet should be set aside. The State opposed, stating that the investigation had uncovered the applicant’s complicity and that the absence of his name in the FIR was irrelevant. The High Court examined the materials and concluded that the charge-sheet was properly filed and there was no ground for judicial interference under the invoked provisions. Consequently, the court dismissed the application, allowing the proceedings to continue.
Issues considered
- Whether an accused not named in the FIR can have the charge‑sheet quashed under Section 528 BNSS/Section 482 CrPC.
- Whether the High Court can interfere with the investigation and charge‑sheet in a cyber‑extortion case on the basis that the accused’s name surfaced only during investigation.

submitted against Ram Singh and Narinder Singh Chauhan (the present
applicant) for offences under Sections 419, 420, 406, 468, 120-B I.P.C. and
Section 66D I.T. Act.
7. The court of the Chief Judicial Magistrate, Gautam Buddh Nagar took
cognizance upon the same and summoned the applicant. Further a charge-
sheet was submitted against the accused Umesh Mahajan for offences under

by the police and no transaction has been done between the applicant and
other accused. It is submitted that the applicant has been granted bail vide

for quashing and submitted that the present case is a case in which a gang
operates and as a result of their work they digitally arrest a person and extort
him which is the present case also in which the informant was digitally
arrested and extorted. She parted with huge amount of money in the same
same sequence. It is submitted that during investigation the implication of the
applicant has surfaced and thus charge-sheet has been filed. It is submitted
that in the present case not naming an accused is not of any relevance in as
much as all the accused who come forward and are even behind the back do
not disclose their correct name and are unknown to the informant or the victim
and thus the name does not surface in the first information report. It is
submitted that it is only once the matter is investigated the complicity of the
accused comes out. It is submitted that thus the present petition be dismissed.
10. After hearing the learned counsel for the parties and perusing the records,
it is evident that the present case is a case of digital arrest. In such a matter
an accused not being named does not have any serious repercussions and
the investigation is done which then brings out the names of the persons
involved in the matter. The charge-sheet in the matter has been submitted
against the applicant. No ground for interference is made out.
11. The present application under Section 528 BNSS is dismissed.
