Allahabad High Court
SMT. GUDIYA @ KAMAR SHAHEEN AND 7 OTHERSversusSTATE OF U.P. AND ANOTHER
- Decided

Holding
The court held that, given the verified compromise and lack of any useful purpose in continuing the prosecution, the charge sheet and related orders may be quashed.
Summary
The applicants filed an application under Section 528 of the B.N.S.S. seeking to quash a charge sheet dated 07‑01‑2025 and related orders in a criminal case (Crime No. 375 of 2023) involving offences under Sections 498‑A, 323, 504, 506, 406 IPC, the Dowry Prohibition Act and the Muslim Women (Protection of Marriage) Act, 2019. The parties had amicably settled the dispute and the compromise was verified by the trial court. Both the opposing party and the State’s AGA consented to the withdrawal of the prosecution. The High Court, relying on Supreme Court precedents that permit compromise even in certain cognizable and non‑compoundable offences, held that continuing the proceedings would serve no useful purpose. Consequently, the charge sheet and the cognizance and summoning order were quashed and the application was allowed.
Issues considered
- Whether a compromise between the parties can justify quashing of proceedings in a case involving cognizable and non‑compoundable offences under the IPC, Dowry Prohibition Act and the Muslim Women (Protection of Marriage) Act.
