Allahabad High Court

NEERAJ KUMAR @ NIRANJAN SINGHversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The non‑bailable warrant shall be kept in abeyance for four weeks, subject to the applicant appearing before the trial court within the time fixed; otherwise it will be executed.

Summary

The applicant, Neeraj Kumar, filed an application under Section 528 of the Criminal Procedure Code seeking to quash a non‑bailable warrant dated 06‑09‑2025 issued by the Special Judge (Gangster Act) in a case under the Gangster Act. The warrant was issued because the applicant failed to appear on several dates despite being directed to do so. The applicant’s counsel assured the court of his willingness to appear before the trial court and cooperate with the proceedings. The State, represented by the Advocate General, opposed the application, citing the applicant’s repeated non‑appearance. The High Court held that the warrant would be kept in abeyance for four weeks, conditional upon the applicant appearing before the trial court within the time fixed; failure to do so would result in immediate execution of the warrant. Consequently, the application was disposed of with the conditional stay of the warrant.

Issues considered

  • Whether the non‑bailable warrant issued under the Gangster Act can be quashed or stayed under Section 528 CrPC?
  • Whether the applicant’s undertaking to appear before the trial court warrants a temporary suspension of the warrant?
