Allahabad High Court

NEERAJ BHARDWAJversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The application for quashing the charge‑sheet and proceedings is declined.

Summary

The applicant, Neeraj Bhardwaj, filed an application under Section 528 of the BNSS seeking to quash the charge‑sheet dated 27‑02‑2025, the cognizance and summoning orders dated 09‑01‑2026, and the entire criminal proceedings (Case No. 2390 of 2026) relating to offences under Sections 498A, 323, 504, 506 IPC and Sections 3/4 of the Dowry Prohibition Act. The High Court examined the material and held that, at the interlocutory stage, it could not be said that no offence was made out against the applicant and that the disputes were factual, not suitable for quash. Consequently, the Court declined the prayer for quashing, directing that if the applicant is not on bail he may apply for bail within 45 days, and that any discharge application filed within the same period be decided by the trial court with a reasoned order. The Court also ordered that no coercive measures be taken against the applicant for 45 days or until the discharge application is disposed. The application was therefore dismissed.

Issues considered

  • Whether the charge‑sheet and the proceedings can be quashed under Section 528 of the BNSS on the ground of lack of offence or abuse of process?
  • Whether the High Court can entertain the application at the interlocutory stage despite factual disputes?
