Allahabad High Court

SRIPAL SINGH RAWATversusSTATE OF U.P. AND 2 OTHERS

Decided

Holding

The High Court exercised its power under Section 529 to direct the Additional Sessions Judge to decide the pending criminal revision within six months and disposed of the application.

Summary

The applicant, Sripal Singh Rawat, filed an application under Section 529 of the Bhartiya Nagrik Suraksha Sanhita, 2023, seeking a direction to the Additional Sessions Judge/F.T.C. No. 1, Gautam Budh Nagar to decide Criminal Revision No. 343 of 2023, which arose from an order dated 26.3.2025 and has been pending since 2024. The High Court noted that the matter was pending for an extended period but did not express any view on the merits of the underlying revision. Relying on the provisions of Section 529, the Court directed the lower court to decide the pending revision expeditiously, preferably within six months, after producing a certified copy of the order, and to avoid unnecessary adjournments. The direction was issued subject to the condition that there be no other legal impediment. The application was thereafter disposed of finally with the said directions.

Issues considered

  • Whether Section 529 of the Bhartiya Nagrik Suraksha Sanhita, 2023 empowers the High Court to direct a lower court to decide a pending criminal revision within a specified time frame without adjudicating the merits.
  • Whether the High Court may impose procedural directions, such as limiting adjournments, to ensure expeditious disposal of a pending case.
