Allahabad High Court

SMT. VERTIKA SINGHversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The High Court exercised its authority under Section 529 to direct the Family Court to decide the pending case within six months, without addressing the merits.

Summary

The applicant, Smt. Vertika Singh, filed an application under Section 529 of the Bhartiya Nagrik Suraksha Sanhita, 2023, seeking a directive to the Principal Judge of the Family Court, Kanpur Nagar, to decide a pending family law matter (Case No. 651 of 2023) filed under Section 125 of the Criminal Procedure Code. The High Court noted that the case had been pending since 2023 and, without addressing the merits, exercised its power under Section 529 to order the Family Court to dispose of the matter expeditiously, preferably within six months, subject to no other legal impediment. The order was issued after the parties were heard, and the application was finally disposed of with the said direction. No substantive findings on the underlying family dispute were made.
