Allahabad High Court

TEJPAL SINGHversusSTATE OF U.P.

Decided

Holding

The High Court held that, under Section 529, it may direct the Sessions Judge to decide the pending trial as expeditiously as possible without unnecessary adjournments.

Summary

The applicant, Tejpal Singh, filed an application under Section 529 of the Bhartiya Nagrik Suraksha Sanhita, 2023, seeking a direction to the Sessions Judge, Baghpat, to dispose of Session Trial No. 1477 of 2024 (arising out of Crime No. 563 of 2024 under IPC sections 147, 148, 149, 452, 427, 504, 307) without further delay. The High Court noted that the trial had been pending since 2024 with no substantive hearing on the merits. Relying on the statutory power conferred by Section 529, the Court ordered the Sessions Judge to decide the case expeditiously and to avoid unnecessary adjournments, provided no other legal impediment exists. No merits of the criminal case were examined. The application was consequently disposed of with the said direction. The order was pronounced by Justice Sanjay Kumar Pachori on 16 September 2026.
