Decided

Holding

The Court dismissed the application as withdrawn, granting the applicants liberty to file a fresh application.

Summary

The applicants, Sachin Saini and three others, filed an application under Section 529 of the B.N.S.S. before the Allahabad High Court. During the hearing, counsel for the applicants expressed that they no longer wished to pursue the application and requested that it be dismissed as withdrawn, with liberty to file a fresh application if needed. The Court considered the request and, finding no objection, dismissed the pending application as withdrawn, granting the liberty sought. The Court also directed the office to return the certified copy and relevant documents to the applicants' counsel after making a photocopy for the record. No substantive merits of the original application were examined, as the matter was disposed solely on procedural withdrawal.
