Allahabad High Court
SMT. SHAHINA KHATOON AND ANOTHERversusSTATE OF U.P. AND ANOTHER
- Decided
Holding
The High Court ordered the trial court to adopt coercive measures and decide the Section 128 application without unnecessary adjournments.
Summary
The applicants filed an application under Section 529 of the B.N.S.S. seeking a direction to the trial court to expedite a pending Section 128 Cr.P.C. proceeding for recovery of maintenance arrears. The trial court had issued notices, a recovery warrant and a letter to the Superintendent of Police, but the opposite party neither appeared nor paid the arrears. The State opposed the prayer. The High Court observed that the opposite party’s non‑appearance justified the use of coercive measures and ordered the trial court to decide the Section 128 application without unnecessary adjournments. Accordingly, the court directed the trial court to adopt the prescribed coercive measures for recovery of the maintenance arrears and disposed of the application finally.
